IMS, Inc./eResponse Privacy Policy IMS, on behalf of its client magazine publishers, has developed it's privacy policy as an assurance to eResponse users that the information collected is done so for the express purpose of providing marketers (known alternatively in this document as advertisers) information on who is interested in information on their products or services. The method employed in IMS collecting this information is the following: Recipient receives eResponse email as a direct result of being a subscriber to the magazine represented in the email. The subscriber data supplied to IMS by the magazine publisher includes the subscriber's email address. The email and its associated IMS linked web pages capture a programmed data string attached to the email address of the subscriber, in effect, allowing IMS to know the actions taken and by whom on its web pages. These actions are related directly to the subscriber information and that information is collected and forward to marketers that have been "clicked" or that have been chosen specifically by the user by reply box and then submitted by the user. This information forwarded to the marketer is in the format of a subscriber record associating that subscriber to the assumed interest generated by clicking hyperlinks or explicit interest generated by the physical submissions of "requests for more information". Each time you receive an eResponse email and link from an email system to the IMS eResponse information site, by doing so you are accepting the practices and methods described in this privacy policy drafted on the date listed in the next paragraph. You agree that by using the eResponse information site, you are expressly and affirmatively consenting to our use and disclosure of the information collected to "the marketers" and the publishers of the specifically identified magazine, and consent to receive emails or other forms of contact, as outlined in this privacy policy. Please review this privacy policy in its entirety and if you do not agree with the IMS methodology, please do not use this service and/or use the opt-out feature available in the body of the email. You will be flagged in the subscriber database as "not wishing to receive" eResponse emailing from the date the opt-out was registered. When we say IMS, eResponse or "we" in this privacy policy, we are specifically making reference to IMS, Inc. a Nevada, USA corporation with offices in Las Vegas and Toronto, Canada. IMS is a publisher services company and not the publisher of any magazine. IMS is not affiliated with any of the marketers listed on its eResponse sites. IMS is acting as a "third party" on behalf of its magazine publishing clients. For more information on IMS, refer to this site: www.ims.ca The Information Collection Process In order to have received an eResponse emailing, except in the instance where the email was forwarded, the recipient would have to be a current subscriber to the magazine and that subscriber would have had to, at one time, supplied to the publisher, their email address. In some cases, permission to send promotional mailings may have been granted by the subscriber, but not exclusively. In order to facilitate the operation the eResponse site and provide you with information on products and services that may be of interest to you, we join your email address by way of a programming string, to your subscription record. The subscriber is not asked for any biographic or demographic information because the magazine has already collected that information. IMS does not share information with "other" marketers, nor is the information supplied to any other marketing organizations or companies other that the specific marketers listed in the eResponse site. Information Other Web Sites May Collect From You On the eResponse site, we place links to other "marketer's" web sites that are owned and operated by those other parties. Some of these other "marketer's" web sites contain tracking capabilities of their own. Consequently, operators of these other "marketer's" web sites may collect different kinds of information about you, and may use and disclose that information in different ways than what we outline in the IMS privacy policy. IMS, Inc. encourages you to take steps to review any sites you may visit for their privacy policies. Again, IMS Inc. is not and will not be responsible for their actions. For those subscribers (you) that wish to remain as anonymous, we recommend that you canvas inquiries for more information from marketers through traditional, non-web-based methods. IP Address Information Like most websites, each time you visit an IMS, Inc. eResponse site, we automatically collect your IP address and the web page(s) from which you came. Under this privacy policy, we are not and will not share that information to any third party including marketers and magazine publishing clients. In order to administer and optimize eResponse sites for you and to diagnose problems with our site, we use your IP address to help identify you. Marketers Contacting You After you visit an eResponse site, you agree that IMS (on behalf of the specified magazine publisher) may send inquiry information to marketers until such time that you so indicate your preference not to receive eResponse. IMS is not responsible for a publisher or marketer's failure to contact you or send you more information from any request generated from eResponse. IMS, Inc. is not responsible for the method in which a publisher or marketer chooses to make contact with you. Divulging Your Contact Information For Legal and/or Administrative Purposes IMS may disclose specific contact information when we determine that such disclosure is necessary to comply with law, to cooperate with or seek assistance from law enforcement or to protect the interests or safety of IMS, publishers or marketers or other visitors to any eResponse site. Also, your contact information may be passed on to a third party in the event of a transfer of ownership or assets, or a bankruptcy, of IMS, with expressed consent of the specific magazine publisher who is the owner of the information. Other Instances Where Your Information May Be Shared If you opt-out of receiving eResponse emails, then we will not share your contact information with marketers or any unaffiliated third parties. If you do not opt-out of receiving eResponse emails, then marketers and publishers may share your contact information with others, outside the control on IMS, Inc. Responsibility IMS, Inc. will not be and is not responsible or otherwise liable for any use of the information collected and forwarded to the magazine publisher or marketers. The actions taken by publishers and marketers would be covered by their own privacy policies, to which end you may find expressed on their individual web sites.
